The legal version. The friendlier privacy explainer is on the Trust and Privacy page. These Terms govern your use of Care Journal, a product of Burna AI, Inc. For legal notices, write to legal@burna.ai. Material changes announced at least thirty days before they take effect.

§1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of Care Journal, a product of Burna AI, Inc., a Delaware corporation (“Burna AI,” “we,” “us,” “our”). By accessing or using Care Journal’s mobile app, web app, or related services (collectively, the “Service”), you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

If you are using the Service on behalf of another person (for example, as a caregiver for a parent, spouse, or child you are authorized to manage), you represent that you have the legal authority to do so, and you agree to these Terms on your own behalf and on behalf of the person you are managing.

§2. Eligibility

You must be at least eighteen years old (or the age of majority in your jurisdiction) to create an account on Care Journal. The Service is designed for adult use. Pediatric oncology patients are managed by a parent or guardian as a dependent on the parent’s account.

You must have the legal capacity to enter into a binding agreement. You must comply with all applicable laws in your jurisdiction.

The Service is currently available in the United States, the European Economic Area, the United Kingdom, Canada, Australia, and selected additional jurisdictions. Use of the Service from a jurisdiction where it is not available is not authorized.

§3. The Service

Care Journal provides audio recording of doctor visits with secure upload; transcription and plain-language summarization; symptom capture and longitudinal tracking; dependent and caregiver management; optional integration with clinical trial workflows (where a trial team uses Care Journal); and optional video documentation through CareVid (in pilot during 2026).

The Service is provided as-is. We may add, remove, or change features. Material changes that affect your record (privacy, retention, data handling) will be announced before they take effect.

§4. Account Terms

You are responsible for maintaining the security of your account. Care Journal uses one-time passcode authentication instead of passwords; you are responsible for the security of the email address and phone number associated with your account.

You agree not to share your account with anyone (except through Care Journal’s explicit sharing features, which use scoped permissions and audit logs).

You agree to provide accurate information when you create an account and to update it if it changes.

You may delete your account at any time. We may terminate your account if you violate these Terms or if we are required to by law.

§5. Your Content

Your record (audio recordings, transcriptions, summaries, symptom notes, profile, dependents) is yours. You own the content you create on Care Journal.

By using the Service, you grant Burna AI a limited license to store, process, and display your content for the purpose of providing the Service to you. This license is non-exclusive and ends when you delete your content or your account.

We do not claim ownership of your content. We do not use your content to train AI models without your explicit, opt-in, revocable consent. We do not sell your content.

§6. Prohibited Uses

You agree not to use the Service for any unlawful purpose; attempt to access another user’s account without authorization; attempt to reverse engineer, decompile, or otherwise circumvent the security of the Service; use the Service to harass, defame, or harm another person; upload content that infringes another person’s intellectual property rights; upload malware, viruses, or other malicious code; use the Service to spam, phish, or distribute commercial messages; scrape, crawl, or otherwise systematically access the Service for purposes other than your own personal use; use the Service in a way that violates the privacy or trust commitments described in our Privacy Notice; or use the Service to misrepresent yourself, your relationship to a patient, or your authority to manage a dependent’s record.

We may terminate your access to the Service for violations of this section.

§7. Not Medical Advice

Care Journal is not a medical device. Care Journal does not provide medical advice, diagnosis, or treatment. The summaries, symptom trackings, and longitudinal observations Care Journal generates are derived from your own recordings and submissions; they are not clinical recommendations.

Do not use Care Journal in a medical emergency. For medical emergencies, call your local emergency number, your doctor’s office, or your clinical trial’s 24/7 line if you are on a trial.

Care Journal does not replace your clinician. Your oncologist, your coordinator, your nurse, and your other care team members remain the people who diagnose, recommend, and treat. Care Journal is a communication and record-keeping tool, not a clinical decision-making tool.

You agree that you will not rely on Care Journal as a substitute for professional medical judgment.

§8. Subprocessors and Third Parties

Care Journal uses third-party service providers (subprocessors) to operate the Service. All subprocessors handling Protected Health Information have signed Business Associate Agreements with Burna AI.

We do not control the practices of third-party services you may use alongside Care Journal (your hospital’s EHR, your calendar provider, your email provider, and so on). Their privacy and security practices are governed by their own agreements with you.

§9. Intellectual Property

Care Journal, the Care Journal logo, “Burna AI,” and related marks are trademarks of Burna AI, Inc. You may not use these marks without our written permission.

The Service, including the software, design, content, and functionality (excluding your own content), is owned by Burna AI and protected by copyright, trademark, patent, and other intellectual property laws. Two patents covering the citation-bound architecture have been filed.

You may not copy, modify, distribute, or create derivative works from the Service without our written permission.

§10. Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Burna AI disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure against all threats, or perfect in any other dimension. We aim for high reliability and we hold ourselves accountable, but we do not guarantee perfection.

§11. Limitation of Liability

To the maximum extent permitted by law, Burna AI, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from or related to the Service shall not exceed the greater of (a) one hundred US dollars, or (b) the amount you paid us for the Service in the twelve months preceding the claim. Since the Service is provided free of charge to patients and families, this amount is typically zero.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the above limitations apply to the maximum extent permitted by law.

§12. Indemnification

You agree to indemnify and hold harmless Burna AI from any claim, loss, or damage arising from your use of the Service in violation of these Terms or applicable law.

This indemnification obligation does not apply to claims arising from Burna AI’s gross negligence, willful misconduct, or violation of law.

§13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles.

Disputes arising from these Terms or the Service will be resolved through informal negotiation in good faith first, then through binding arbitration where permitted by law, and only thereafter in the courts of Delaware. Where the law of your jurisdiction limits arbitration of consumer claims (notably the European Union and certain US states), the local statutory dispute-resolution process applies.

§14. Modifications to These Terms

We may modify these Terms. Material changes will be announced by email to your registered address and by an in-app notice at least thirty days before they take effect. The “Last Updated” date at the top of this document reflects the most recent change.

If you do not agree to a material change, you may delete your account before the change takes effect.

§15. Termination

You may stop using the Service and delete your account at any time.

We may terminate your access to the Service if (a) you materially violate these Terms, (b) we are required to by law, or (c) we discontinue the Service. If we discontinue the Service, we will provide at least ninety days’ notice and allow you to export your content before shutdown.

§16. Severability

If any provision of these Terms is found unenforceable, the remainder remains in effect.

§17. Entire Agreement

These Terms, together with the Privacy Notice and any other documents we explicitly incorporate, constitute the entire agreement between you and Burna AI regarding the Service.
